TempSureShip Terms of Service
Effective date: 24 October 2026 Last updated: 24 October 2026
1. About these terms
These Terms of Service ("Terms") are an agreement between you, the merchant who installs the TempSureShip app ("you"), and TempSureShip LLC, a Colorado limited liability company, 73 Baylor Dr, Longmont, CO 80503, United States ("TempSureShip", "we", "us").
They cover the TempSureShip Shopify app, its admin pages and extensions inside your Shopify admin, and the related Shopify Flow trigger and action (together, the "App"). The free public Ship Check at https://tempsureship.com/check is covered by our Privacy Policy and section 7 (acceptable use) only.
You accept these Terms by installing the App on a Shopify store. If you install it for a business, you confirm that you have authority to bind that business. The App is for business use only, not for consumers.
The Data Processing Addendum ("DPA") forms part of these Terms. Our Privacy Policy explains what data we handle and why.
2. Who the App is for
The App is for Shopify merchants who ship temperature-sensitive products (for example live plants, chocolate, wine, candles, skincare or perishable food) from the United States and want a weather check before each order ships. The origin of every check is a US location. Destinations outside the United States can be checked where our weather providers cover them; where they do not, the App says it does not have enough data.
3. What the App does
For each order, the App:
- estimates how many days the parcel will be in transit, from the shipping method on the order or the defaults you set;
- looks up the weather forecast at the origin, a midpoint on the route and the destination for those days;
- compares the forecast with the temperature ranges you set for your product types, allowing for the packaging options you set up; and
- returns one of five results, each with a plain-language explanation: Safe to ship, Ship with mitigation (for example add a cold pack or choose a faster service), Do not ship, Needs review, or Insufficient data.
The App records each result, tags the order with it, writes the result and its summary to the
order as tempsure.* metafields, shows it in your Shopify admin and can trigger Shopify Flow.
What else it does depends on the automation mode you choose (section 5).
4. What the App does not do
The App gives recommendations. You decide whether and how to ship, and you remain responsible for every shipping decision. In particular:
- Forecasts are third-party predictions. Weather data comes from the third-party services listed on our Data Sources & Attribution page and in the DPA. Forecasts can be wrong, change after a check, or be unavailable.
- Transit times are estimates. The App estimates transit from the shipping method, distance and business days. Carriers can be late, miss a scan, hold a parcel at a depot or route it differently. The App does not track parcels in real time and does not know the actual conditions inside a truck, depot or mailbox.
- Results depend on your settings. The App applies the temperature ranges, transit limits, packaging options, origin and shipping days you enter. It does not check that they suit your products.
- No guarantee of outcome. A "Safe to ship" result does not guarantee that a parcel arrives undamaged, and a "Do not ship" result does not mean the parcel would have been damaged.
- Missing or stale data is never treated as safe. When the App cannot get the data it needs, it returns "Insufficient data" or "Needs review" and asks you to decide.
- The App is not a carrier, an insurer, a guarantee or warranty for your customers, or a system for meeting any food-safety, alcohol, plant-health or other regulation that applies to your products. Keep your own records where the law requires them. The App's CSV export and printable shipping decision records are there to help you do so.
5. Automation modes
You choose the automation mode in the App's settings and can change it at any time. A new installation starts in Manual mode.
| Mode | What the App does to your orders |
|---|---|
| Manual (default) | Evaluates orders, adds a result tag (for example tempsure-hold), writes the tempsure.* metafields, shows notifications and triggers Shopify Flow. It never places or releases a fulfillment hold. You place and release holds yourself. |
| Semi | The same as Manual. Tags are applied automatically and you place holds yourself. |
| Auto | Everything above, and it also places a fulfillment hold on orders it rates Do not ship. While an order is held, the App re-checks it about every 30 minutes. When conditions improve to Safe to ship or Ship with mitigation, it releases the hold it placed. It never releases a hold that you, another app or a staff member placed. |
In every mode:
- you can override a result ("Ship anyway" or "Hold order"), and the App records your override;
- you can release any hold in Shopify at any time;
- you can pause the App, and a paused App does not evaluate new orders; and
- Shopify Flow workflows you build on the App's trigger are yours to configure and check.
If Shopify refuses an action (for example a hold or release), the App tells you, and you must take the action yourself.
6. Price
The App is free. There is no subscription fee, no usage charge and no order limit.
If we introduce a paid plan later:
- it will be charged only through Shopify's billing, never by us directly;
- we will give you at least 60 days' notice before any price change affects you; and
- the free plan will remain available.
You are responsible for any taxes that apply to your use of the App, and for your own fees with Shopify, carriers and other providers.
7. Acceptable use
You must not, and must not let anyone else:
- use the App in breach of the law, Shopify's terms, or the rights of your customers or others;
- try to access another merchant's data, or any part of our systems you are not given access to;
- interfere with or overload the App, including by bypassing rate limits or sending automated traffic to the App or the public Ship Check;
- copy, resell, sublicense or offer the App or its results as a service to others, or use them to build a competing weather-risk dataset by bulk extraction;
- reverse engineer the App except where the law allows this despite this restriction; or
- upload or enter malicious code, or content that is unlawful or infringes others' rights.
Security research. We welcome good-faith security research. Report suspected vulnerabilities to [email protected], give us a reasonable time to fix them before you disclose them, and do not access, change or keep other merchants' data or degrade the service. We will not pursue legal action against research done in good faith and within these limits.
We may suspend your access to the App if your use breaches this section or creates a security risk. Where we can, we will tell you first and give you the chance to fix the problem.
8. Availability and support
We aim to keep the App available but do not promise any level of availability. The App depends on Shopify, our hosting provider and our weather and geocoding providers, and any of them can fail. We may need to take the App offline for maintenance or to protect your data. When data is unavailable, the App returns "Insufficient data" rather than a "Safe to ship" result.
We may change, add or remove features. We will give you reasonable notice of a change that materially reduces what the App does for you.
Support is by email at [email protected]. We aim to reply within 2 business days. Shopify cannot provide assistance with the installation or use of the App (see section 10).
9. Your data
- Your data stays yours. Your configuration, your orders' evaluations and your customers' data belong to you or your customers. We use them only to provide the App to you, as described in the DPA and our Privacy Policy. We do not sell them or use them for advertising.
- Your customers' personal data. For the limited customer data the App processes (destination ZIP/postal code, city, state/province and country, plus the items on the order), you are the controller and we are your processor. The DPA sets out the terms, including security, sub-processors, breach notification and deletion.
- Your notice to customers. You are responsible for telling your customers, in your own privacy notice, that you use service providers such as the App to process order and shipping information.
- Your account information. For the information we hold about you as a merchant (your shop domain, and any contact details you send us), we are the controller, as described in the Privacy Policy.
10. Shopify
Shopify is not a party to these Terms. As between you, Shopify and us:
- TempSureShip is solely responsible for the App;
- Shopify is not liable for any fault in the App or any harm that may result from its installation or use;
- except where Shopify expressly states otherwise, Shopify cannot provide assistance with the installation or use of the App; and
- TempSureShip, not Shopify, is solely responsible for any liability that may arise from your access to or use of the App, including the development, use, marketing or distribution of, or access to, the App (including its support), and our access to, use, distribution or storage of your data.
Section 10 does not increase our liability to you beyond section 15.
Your use of Shopify is governed by your own agreement with Shopify.
11. Third-party services
The App uses third-party weather, geocoding and hosting services, listed in the DPA. Their data is provided under their own terms, and attribution is on our Data Sources & Attribution page. We are not responsible for their accuracy or availability, but we are responsible, as the DPA sets out, for the sub-processors we choose to handle your customers' data.
12. Intellectual property and feedback
We own the App, including its software, design, explanations and documentation. While the App is installed, we grant you a non-exclusive, non-transferable, revocable right to use it for your own store's business under these Terms. You own the evaluations, exports and decision records you create with the App and may use them as you wish.
If you send us suggestions, we may use them without obligation to you.
13. Ending these Terms
You can stop at any time by uninstalling the App. When you uninstall:
- the App deletes all data it holds about your store (settings, product types, packaging options,
evaluations, audit history, notifications and sessions) immediately, and again when Shopify sends
its
shop/redactrequest 48 hours later; - our hosting plan keeps no automated database backups, and any manual snapshot that holds your data is deleted within 30 days, so no copy of your data outlasts the uninstall by more than 30 days; and
- order tags and
tempsure.*metafields the App wrote to your orders stay in your Shopify store, under your control. You can remove them like any other tag or metafield.
Export your evaluations as CSV, or print shipping decision records, before you uninstall if you want to keep them.
We can end these Terms, or suspend your access, if you materially breach them and do not fix the breach within 14 days of our notice, or immediately where needed to protect the App, other merchants or the law. We may also discontinue the App for everyone with at least 30 days' notice.
Sections 9, 10, 12 and 14 to 19 survive the end of these Terms.
14. Disclaimer
The App is provided free of charge, "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be uninterrupted or error-free, that forecasts or transit estimates will be accurate, or that following a recommendation will prevent damage to any shipment.
Some jurisdictions do not allow some of these exclusions, so some may not apply to you.
15. Limitation of liability
To the fullest extent the law allows:
- We are not liable for indirect or consequential losses, including lost or spoiled products, replacement shipments, refunds, chargebacks, carrier claims, lost profits, lost revenue, lost goodwill or lost data, arising out of or relating to the App or these Terms, even if we were told they were possible.
- Our total liability for all claims arising out of or relating to the App or these Terms is limited to US$100 or the total fees you paid us for the App in the 12 months before the claim, whichever is greater.
- These limits apply whatever the legal theory (contract, tort including negligence, or otherwise).
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence.
16. Your responsibility to us
You will defend and compensate us against third-party claims (including claims by your customers) that arise from your breach of section 7, your breach of the law, or the shipping decisions you make, except to the extent the claim is caused by our breach of these Terms or the DPA.
17. Changes to these Terms
We may update these Terms. For a material change, we will give you at least 30 days' notice by email to your store's contact address or in the App, before the change takes effect. A change needed for legal or security reasons may take effect sooner, and we will say why. The "Last updated" date at the top shows the current version, and earlier versions are available on request.
If you do not agree to a change, uninstall the App before it takes effect. If you keep using the App after that date, the updated Terms apply.
18. Governing law and disputes
These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. The state and federal courts for Boulder County, Colorado have exclusive jurisdiction over any dispute, except that either of us may seek urgent injunctive relief in any competent court, and either of us may bring a claim that qualifies in a small-claims court instead. There is no arbitration. Before starting proceedings, please contact us so we can try to resolve the matter informally.
If you are in a jurisdiction whose mandatory law gives you rights that these Terms cannot exclude, those rights are not affected.
19. General
- Entire agreement. These Terms, the DPA and the Privacy Policy are the whole agreement between us about the App. If they conflict about personal data, the DPA prevails.
- No restrictions on your business. Nothing in these Terms requires you to use us exclusively, stops you from building or using competing products, or limits whom you do business with.
- Assignment. You may not transfer these Terms without our consent. We may transfer them to a successor that takes over the App and agrees to be bound by them and the DPA; we will tell you if we do.
- Events outside our control. We are not liable for delays or failures caused by events beyond our reasonable control, including outages of Shopify, hosting or data providers.
- Severability and waiver. If a provision is unenforceable, the rest stays in force. A failure to enforce a provision is not a waiver.
- Notices. We send notices to the email address associated with your store, or in the App. You send notices to [email protected].
